Oracle v. Google: Judge finds structure of Java APIs not copyrightable, renders jury infringement verdict moot

Image

Thought the Oracle v. Google litigation fireworks were over? Well, if you weren't aware, during the copyright phase of the trial, the jury found that Google had infringed the structure, sequence and organization of Oracle's Java APIs. However, at the time, Judge Alsup had yet to evaluate the validity of Oracle's API copyright claims upon which that verdict was based. Today, Alsup found that Oracle's argument didn't hold water because it would expand the breadth of copyright holder's rights too far -- in essence, it would allow owners of software code to prevent others from writing different versions to perform the same functions. This ruling renders the jury's earlier infringement verdict moot, and gives Mountain View yet another courtroom victory. Despite this latest defeat, Oracle's sure to run the case up one more rung on the legal ladder, so let the countdown to the appeal begin.

HTC EVO 4G LTE hitting Sprint stores on June 2nd

With the phones no longer locked up in customs, the HTC EVO 4G LTE has already shipped out to pre-orderers last week, but it still hasn't been made available in your local Sprint store or third-party affiliate. That will all change this Saturday, June 2nd, as the Now Network has announced that the device will launch "in most retail channels." Google Latitude check-in deals now available across the US

Recently, Google has been busy beefing up Latitude to make it more competitive with other location apps -- and more fun to use. Location history was added recently, iOS users can post check-ins via Latitude, and now Google has begun rolling out location-based deals which are tied to the service.

If you're in the U.S., you can now score local savings at participating merchants by checking in with Latitude. Google will also be offering "status deals," which users can unlock by visiting a particular merchant on a regular basis. Mashable notes three status levels: regular, VIP, and guru -- though partners can apparently customize those titles if they choose.

Right now deals are available from merchants like American Eagle Outfitters, Arby's, Finish Line, Macy's, Quiznos, and RadioShack.

Apple was apparently threatened by Spotify's U.S. entry

Most of the really interesting stuff from the D10 relating to Apple has come from the Tim Cook interview, but another interesting tidbit came from an interview with Spotify's Sean Parker and Daniel Ek. When asked if Apple had tried to stop Spotify from entering the U.S. market, Parker hesitantly answered, "There was some indication that that might have been happening."

Engadget HD Podcast 296 - 04.25.2012As we kick off the 300+ episode era, we welcome a guest, Engadget's own Steve Dent, to talk about high frame rate 3D filmmaking and why (or if) we should be excited about it. Other big news in the week gone by are new developments in Amazon streaming as it launched on the Xbox 360, while Comcast's VOD is popping up on Android and more TiVos. Ultra HDTV is also closer to becoming a reality, while LG officially took the wraps off of its first OLED HDTV. We'll also dig into NBC's Olympics broadcast plans (good news for streaming, not great news for 3D), while the E.T. Blu-ray gets a trailer and we talk about what to watch for the summer.

LoveFilm introduces HD streaming in the UK and Germany, adds another nail in mail rental coffin

Lovefilm certainly seems to be on the charm offensive to secure those movie viewing eyes. Yesterday it was the announcement of an exclusive deal with NBCUniversal, and today it's HD streaming for its "Instant" service. Subscribers in the UK and Germany can suck up full 1080p content when viewing on a Mac or PC, and 720p when watching via Xbox 360 or Smart TV (UK only) at no extra cost. The HD library is rolling out now, and currently includes only a selection of films and TV shows, but is set to expand over the coming months. So if you're a paid up member, you can start browsing the library today, and hunt out those HD badges.

Windows 8 getting a built-in PDF reader, Metro-style

For what seems like an eternity, Download Squad readers have reacted to news of security exploits targeting Adobe Reader with a common sentiment: why doesn't Microsoft build its own secure PDF reader into Windows? Apparently the Windows 8 team agrees, and they're working away at an application called Modern Reader which is exactly that.

From the handful of screenshots Paul Thurrott has shared, it's clear that Modern Reader has been built with Metro in mind. You can see the Reader back button in the top-left corner of the yellow image and the minimal page navigation bar on the right. We've posted some larger images we managed to scrape from Google's cache after the break.

Thurrott also mentions that Modern Reader is the first program spotted which is built using AppX -- a packaging technology that may allow developers to roll a single build to both Windows 8 desktops and Windows Phone 8 mobile devices.
